1. About these terms

These terms govern your use of the Sell My Car Quick Today website (https://sellmycarquicktoday.com) and any sale of a vehicle to us. By using the site or selling us a car, you agree to these terms.

The site and related vehicle-buying services are operated by Essex Car Store Limited (company number 11687647), trading as Sell My Car Quick Today.

2. Online valuation

The valuation displayed on our website is an estimate based on the information you provide and current market conditions. The final offer is subject to physical inspection at one of our centres. If the vehicle materially differs from the description provided, we reserve the right to revise the offer.

Online valuations are valid for seven days from issue.

3. Booking an appointment

Booking an appointment does not constitute a binding contract to sell. You may cancel or reschedule any appointment without fee.

4. Sale of the vehicle

A binding sale is formed only when both parties sign the V5C transfer of ownership at the appointment and payment has been completed. By selling, you warrant that:

• You are the legal owner of the vehicle (or authorised to sell it).
• The vehicle is free from any undisclosed finance, debt, or legal claim.
• The information provided about the vehicle is accurate and complete.
• You are over 18 years of age.

5. Payment

Payment is made by Faster Payments bank transfer or, by prior arrangement, in cash. We will not release payment until the V5C transfer is complete and identity checks are satisfied.

6. Outstanding finance

Where the vehicle has outstanding finance, the agreed sale price will first be applied to settle the finance balance. Any surplus is paid to you. If the settlement figure exceeds the sale price, you must pay the difference before the sale can complete.

7. Limitation of liability

Nothing in these terms excludes or limits our liability where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, and any other liability that cannot be excluded or limited under English law.

If you are a consumer, nothing in this section affects your statutory rights under the Consumer Rights Act 2015 or other mandatory consumer protection legislation, including any rights that apply once a binding agreement to purchase your vehicle has been formed.

Subject to the paragraphs above, your use of the website, online valuation, booking tools and any content we publish is at your own risk. We provide them on an “as is” and “as available” basis. We do not warrant that the site will be uninterrupted or error-free, or that valuations or other information will be complete or suitable for your particular circumstances (see also section 2 regarding estimates and inspections).

To the fullest extent permitted by law, we will not be liable for any indirect, consequential or special loss or damage (including loss of profit, loss of income, loss of opportunity, loss of goodwill, wasted expenditure or loss of data) arising out of or in connection with these terms or your use of the site, even if we were aware that such loss might arise.

Subject to the first two paragraphs of this section, our total aggregate liability to you in contract, tort (including negligence) or otherwise for loss or damage arising out of or in connection with your access to or use of the website, online valuation or booking facilities (but not including claims relating to a completed vehicle purchase once a binding sale has been agreed at appointment, which remains governed by applicable law) shall not exceed one hundred pounds (£100) in aggregate in any twelve-month period.

8. Governing law

These terms are governed by the laws of England and Wales. Any dispute is subject to the exclusive jurisdiction of the English courts.
